Litigation and Dispute Resolution
Go and Umali has a strong litigation arm, handling civil, commercial, criminal, tax, administrative, arbitration and specialized litigation before judicial and quasi-judicial bodies, representing both the defense and prosecution. The Firm represents parties to disputes in a wide array of areas and subjects such as contract breach, creditor claims, election controversies and protests, environmental law, enforcement of civil and political rights, medical malpractice, family relations, torts and damages, property ownership and land disputes, estate settlement, probate of wills, tax and banking, construction disputes and stockholders’ suits.
The Firm is heavily involved in assisting and representing clients before all court levels, with extensive experience and significant expertise in appellate and Supreme Court litigation, as well as before the Department of Justice, Office of the Ombudsman and the Sandiganbayan.
Acted as counsel and represented a former President of the Republic of the Philippines before various bodies (ie. the Commission on Election, Department of Justice, Office of the Ombudsman, Sandiganbayan and the Supreme Court):
– Successfully defended and secured the dismissal of several cases filed against the former President
– Successfully secured a Temporary Restraining Order (TRO) from the Supreme Court to enjoin and prevent the continuation of Sandiganbayan proceedings
– Successfully secured reversal of probable cause findings of the Office of the Ombudsman
Represented former government officials before the Supreme Court and successfully secured (i) TROs enjoining proceedings before lower courts; (ii) dismissal of administrative charges leading to their reinstatement; and (iii) acquittal and dismissal of criminal charges for purported violation of environmental, anti-graft and procurement laws
Acted as counsel for numerous public officials responding to the audit findings and notices of disallowance issued by the Resident Auditor before the Commission on Audit
Represented public officials (both former and incumbent, which includes former Cabinet Secretaries, City Mayors, Heads of GOCCs) and successfully sought the dismissal of criminal and administrative cases filed before the Office of the Ombudsman
Acted as counsel of a leading real estate company in its arbitration of a construction dispute before the Construction Industry Arbitration Commission
Rendered legal advisory services to a local government unit in its tax protest before the Bureau of Internal Revenue and the Court of Tax Appeals, including successfully securing a suspension of collection order against the Warrant of Distraint and Levy issued by the BIR.
